Smile to Stories, including its agents, contractors, and employees (collectively “Photographer”), is a professional photography service based in Canberra. Please read these terms & conditions carefully before using our online booking form. These terms form a legally binding agreement between the person or entity booking our services (and their legal representatives and assigns) (“Client”) and Smile to Stories (“Photographer”).

 

•All bookings must be confirmed by the Photographer prior to attending the appointment.

•Next-day delivery applies to business days only.

•Any additional fees will be communicated to the Client before services are undertaken.

•Clients are responsible for informing their Vendors, Tenants, or Landlords of appropriate appointment times.

•If a property is unattended at the scheduled time, a 50% cancellation fee of the total booking will apply.

•Properties located more than 100 km from Smile to Stories’ base may incur additional travel charges (up to $0.40 per kilometer), which will be confirmed prior to service.

 

•All works (photographs, videos, floorplans, or graphics) will be supplied electronically via email.

•Low-resolution images with watermarks may be supplied until full payment is received. High-resolution images will be released upon payment.

•Invoices will be issued within 5 days of completion unless otherwise advised. Payment must be made according to invoice terms.

•No Licence Usage Agreement is granted until full payment has been received.

 

•The Client confirms that all necessary permissions and legal access to the property have been obtained.

•The Photographer will comply with all workplace health and safety laws and respect the property at all times.

•The Photographer is not liable for any inability to photograph parts of the property due to safety, access restrictions, or Force Majeure events.

•The Photographer’s liability is limited to fees paid for the specific property photoshoot.

•The Client agrees to indemnify and hold harmless the Photographer from any claims, damages, or expenses related to photographing the property.

 

 

•All copyrights in photographs, videos, floorplans, or graphics remain with Smile to Stories.

•The Photographer retains the right to use, display, or license the media in any format or medium, including websites, brochures, and social media.

•The Client warrants that all people appearing in photographs have given consent to be photographed.

•The Client agrees to release and indemnify the Photographer from any claims arising from the use of photographs.

 

 

•Standard licence grants the Client a non-exclusive, limited right to reproduce, display, and distribute photographs solely for promotional purposes directly related to the property listing.

•Licence expires once the listing purpose is achieved.

•The licence is non-transferable and cannot be resold, sub-licensed, gifted, or assigned.

•Breach of licence terms will result in immediate termination of usage rights.

 

 

•Termination of this agreement does not affect accrued rights from prior breaches.

•This Agreement is governed by the laws of the Australian Capital Territory, and parties submit to its courts’ jurisdiction.

•If any provision is found invalid or unenforceable, remaining provisions remain in effect.

•Delay or non-exercise of any rights does not constitute a waiver.

•All packages come with a 100% satisfaction guarantee.
